Terms of Service

1. Eligibility

By using the Service, you represent and warrant that:

• You are at least 13 years of age (or 16 years of age if you reside in the European Union). If you are under the legal age of majority in your jurisdiction, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
• You have the full power and authority to enter into these Terms and doing so will not violate any other agreement to which you are a party.

2. User Accounts and Credits

• Registration: You may access certain features of the App by registering an account through third-party login providers (such as Google Sign-In or Apple Sign-In). You agree to provide accurate, complete, and up-to-date information for your account.
• Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Credits and Subscriptions:
  • FaceSwap uses a credit-based system to process video transformations. Credits can be purchased in packages or acquired via subscription.
  • All payments, purchases, and subscriptions are processed and managed securely through Google Play In-App Billing.
  • Credits are virtual items with no real-world monetary value, are non-transferable, and cannot be redeemed for cash.
  • All purchases are final and non-refundable, except as required by applicable law or Google Play Store policies.

3. User-Generated Content and Acceptable Use

You retain ownership of the photos, videos, and facial data you upload to the App ("User Content"). However, by uploading User Content, you grant us a temporary, worldwide, royalty-free license to host, store, and process your User Content solely for the purpose of providing the face-mapping and video generation services to you.

Prohibited Conduct and Content

You are strictly prohibited from using the Service to generate, upload, or share any content that:

1. Lacks Consent: You must not upload facial images or videos of any individual without their explicit, prior consent. Creating deepfakes or face-swaps of individuals (including public figures, celebrities, friends, or strangers) without their permission is strictly prohibited.
2. Sexually Explicit: Contains pornography, nudity, or sexually suggestive themes.
3. Harmful or Defamatory: Is harassing, abusive, defamatory, threatening, hateful, or discriminatory.
4. Infringing: Violates the copyright, trademark, or privacy rights of any third party.
5. Misleading or Impersonating: Is intended to deceive, spread political disinformation, or impersonate real people or entities.

We reserve the right to review, monitor, and remove User Content or suspend/terminate accounts at our sole discretion if we suspect a violation of these rules.

4. Proprietary Rights

• Our Intellectual Property: All rights, title, and interest in and to the Service (excluding User Content), including the App's design, text, software, algorithms, graphics, and trademarks, are owned by or licensed to Yumshu.
• Generated Outputs: Subject to your compliance with these Terms, we grant you a non-exclusive, perpetual, worldwide right to use, download, and share the video outputs generated by the Service. You are solely responsible for ensuring that your use of the generated outputs does not violate third-party intellectual property or publicity rights.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YUMSHU DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR ACCURATE, OR THAT THE QUALITY OF GENERATED VIDEOS WILL MEET YOUR EXPECTATIONS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YUMSHU AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO OR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

7. Termination

We reserve the right, without notice and at our sole discretion, to terminate your license to use the Service and to block or prevent your future access to the Service for any reason, including but not limited to your breach of these Terms.

You may terminate these Terms at any time by deleting your account through the App settings and uninstalling the App. Upon termination, all licenses granted to you will immediately expire.

8. Governing Law

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the jurisdiction where Yumshu is registered, without regard to its conflict of law principles.

9. Changes to These Terms

We may update or modify these Terms from time to time. If we make changes, we will post the revised Terms in the App and update the "Effective Date" at the top. Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the changes.
